As far as I know, even if the letter “e” of the one who registered it first is similar to another “e” of the one who registered it second, then this is already considered a violation. Correct me if I’m wrong…
In case of looming trouble, they could just go ahead and change it to MurenaOS or whatever and use the Murena logo to avoid trouble.
Also, it could be they are treading a fine line already, so I would suspect they have somebody at hand who knows stuff in this field so they don’t get into trouble.
MurenaOS is also a distinctive search term, which would help general Internet users find discussions, documentation, and introductions of the platform more easily. Neither e (since punctuation is generally ignored, even by Google within quotes) nor eOS are very good for this on text-based web search.
As for speculation on possible trouble with the Murena name (since this topic here is about logos and trademarks) … apparently there was a comic book and a car, at a minimum … So, it is MURENA ! ... Long life to Murena!
